First question in an accident were the at party person assumes responsibility of the car and both parties decide to not go through insurance both parties have to come to an agreeable amount right? Seems right, right. Second- If the party not at fault is not happy with the agreed amount and decided to go through insurance instead, but the damage exceeds the value of the victims car, is the responsible parties insurance going to pay out the amount of the damage done, I got 4 estimates or it the insurance going to pay only the value of the car and salvage my title? Second, can the responsible party pay out the amount that is agreed upon and then expect to get the victims (my) car in return? Or is his considered extortion? Cause there is no f-in way I the person who is not responsible for the accident can find a reliable car for 1500 bucks, but could part out, or retire my car, sell my car and get more plus the 1500 she agreed upon. I am afraid that if insurance is involved they are going to total my car out thus costy me hundreds more, then it will be worth nothing and I would not be able to retire it and get money from that or even sell it. Lastly, this person has no right to ask me for my car right, she caused the accident and is responsible for paying for that damage that she cause one way or another. Please help me figure this out.

I originally had State Farm and was paying $232 for a Hyndai Tiburon, had a traffic accident for, Improper Lane Change, the other person did not file a claim, had to spend $500 to get my car fixed and $89 on municipal court fees. I looked at new insurance here and found one with Mercury Auto Insurance through a 3rd party company and received a quote for full coverage at $232 a month, so back down to normal price. They ran my license and everything, everything was fine, I even told them about the accident and they said that it would not change rates. Well, it did. I got my first statement and my bill was $314! I called up to the 3rd party company and they said that the insurance company charged my Improper Lane Change, as an Erratic Improper Lane Change, and as such it was classified as a traffic accident on my license and that's what made it go up. She said she would call me back, but she never did and I have been working so much, I haven't had a chance to call back. So here is what I need to know, and please no stupid insurance companies trying to solicit. 1. Who do I call in Ga. and have them dismiss those charges on my license and if they can't, how do I go about filing a lawsuit for illegal allegations after trial? 2. I also suffer severe depression brought upon by my life situation. I returned to college last year, and I am working towards finishing my degree (English/ethnic studies). I need help, both medical/financial help, but I'm not sure where to turn. The job I have is an independent contractor job (I'm not a salaried employee); therefore, I have no benefits. I just drive around to local police stations, pick-up arrest records, transcribe them, and send them in to company. Very basic! My life feels like a living hell; the only thing that makes me feel better is that I am an active student (CSULB) who is about one year away from my degree (better late than never). But I have extreme difficulty functioning day-to-day because of my chronic pain issues and depression. Living with my parents at my age makes my depression worse. I would appreciate any advice. The last full-time job I had was when I worked for the city of Los Angeles (up to 2007), but I had to give that up because of my hip/pain problems. It was a civil service job, so we didn't pay into social security. I'm not sure what I qualify for, and trying to search around on the internet is exhausting. I need to get tags for my car this month, only when I called my car financing company to see how much it is, they told me that my insurance had lapsed, and my registration was suspended!! I had no idea, because my cousin had gotten the insurance for me (we are now estranged, and I don't have any contact with her), and I was told by her the insurance expired in May. All my documments have been sent to her house (and she refuses to send me my mail) and I had no idea. OK, so I got my car insurance renewal to start on 16 May, and it went up from 40 a month to 60, for no gosh darned reason. Grrr. I know that the insurance has gone up a lot, and I think they blame the compensation claims for this, but up a THIRD! Jeeeeeez! Last year, it went up from 35 a month to 50 and I had a whinge down the phone at them, and they reduced it to 40 by changing the recovery a bit (I don't get help now unless I am more than a mile from home; but the chances are I would be when I broke down anyway, and even if I was half a mile away, I could walk back!) so I agreed to change that. So I rang them today and they said they can lower it a fiver because I am a 'loyal' customer, (so down to 55 a month.) Big deal! I am nearly 40, I passed my test 20 years ago, and I have been with them 10 years and NEVER made a claim, and yet they bump my premium by a third! I am like It's a LOT of dosh. Does this seem like a ludicrous leap to you? Has yours gone up a lot too? Does this sound like a high amount to pay? (55 to 60 a month.) Or reasonable for a 38 year old woman? It does include recovery in this quote, and the recovery is about 130. But 2 years ago, I was paying 35, and this year they are asking for 60 a month! I do like this insurance company and have my home insurance and pet insurance with them too, and don't want to leave, but a jump of a third!
